Donald Trump’s tax proposal will cut taxes primarily for businesses and the wealthy — he still hasn’t released his taxes. To make matters worse, Trump will soon be able to appoint a new director of the agency auditing his taxes and lawyers say there’s nothing to stop Trump from appointing an IRS chief who will go easy on him while scrutinizing his political enemies, according to Politico.
Caplin & Drysdale tax lawyer Chris Rizek, who served in the Treasury Department’s Office of Legislative Counsel in the Clinton administration said, “There is precious little statutorily that prohibits that.”
And Trump is known to take every advantage possible if it benefits him. After all, he bragged about not paying taxes for almost two decades after that bombshell was revealed.
According to law, the president and his staff are prohibited from asking the IRS to audit or stop an audit of any given taxpayer, however, there are ways around that, according to David Herzig, a law professor at Valparaiso University.
“For him to say, ‘I’m going to audit the Clinton Foundation,’ that theoretically could violate” the statute, said Herzig. “But if he said ‘I’m only going to hire an IRS commissioner that’s going to follow my rules of not auditing presidents and auditing certain foundations with donations from foreign donors,’ I’m not sure that does.”
Trump has so many conflicts of interest at the moment, it’s almost impossible to document them all. For example, he’s encouraged foreign diplomats to stay at his hotels. He’s gone as far as to press British politicians to oppose a wind farm that could block the view from his golf course. Trump met with Indian businessmen about building an apartment complex near Mumbai.
Trump invited his children to sit in on meetings with foreign leaders and possibly asked a head of state in to clear the path for permits he needs to build a high-rise, according to ThinkProgress.
But according to Trump, the law is on his side and “the president can’t have a conflict of interest.”
The Constitution begs to differ. Trump supporters have been played for suckers. Trump wanted the keys to the White House for monetary reasons. He is the first president in recent memory to enter office while under audit. He’s not even in office yet and he’s broken quite a few campaign promises and now, he’s drunk with power.
